TERMS AND CONDITIONS
TERMS & CONDITIONS OF CONTRACT FOR PHOTOGRAPHY & VIDEOGRAPHY SERVICES
Please read and understand the terms and conditions below.
In consideration of both parties good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties here to agree as follows:
Kindly retain a copy of these for your records.
- THE COVERAGE
Ted Visual is responsible for supplying the client with a photography & videography service and products that have been agreed upon by both parties prior to the wedding or event.
The client will pay the agreed-upon charge to Ted Visual subject to the following conditions:
- PAYMENT AGREEMENTS
A deposit of RM300/RM500 is required to secure the wedding date. These RM300 & RM500 are non-refundable and non-transferable because it is the company agreed-upon loss in the event of cancellation. A month before the wedding, the balance must be paid in full.
Payments received after the due date are subject to a 10% late fee. If the balance is not paid by the end of the week before the wedding, the team may refuse to capture it. The Terms and Conditions must be agreed upon well in advance of the big day.
- PRODUCT DELIVERY/PRODUCT COLLECTION
Photo editing may take 2-3 weeks and video editing may take 2-3 months, not including Friday, Saturday, and Sunday depending on the season. And albums are expected to be completed between 30 working days period from client layout album approval. If it's the wedding season, photos/videos/end product delivery times may be extended.
The client acknowledges that Ted Visual is sending the album and printing to a third-party production company, which may experience delays in delivering the final product, resulting in album printing delays for the client. The client comprehends and accepts the unexpected delay.
The client will receive a printed album, a large print with a frame (depending on the package the client chose).
- RETOUCHING
Exposure, brightness, contrast, and sharpness will all be changed. The editor's appraisal of the changes, as well as the number of images supplied to the client, is correct. The editor will edit the photos to their liking and style. Extensive retouching, digital modification artist finishing, and color-to-black & white conversions are available at extra expense. Ted Visual may decline to edit the photos in a way that deviates from Ted Visual styling and the accepted standard.
- PHOTO/VIDEO AMENDMENT
Clients have two weeks to respond if there is a change or adjustment to how videos are edited. The client may revise the video's editing once. The amendment fees will range of starting RM200 - RM1,000 depending on minor or major amendment. In the event that a client requests a re-edit of the images, there will be an additional fee.
Please note that the final outcome of an event may vary from the photos/videos displayed on social media platforms. Differences can arise due to factors such as variations in decorations, lighting conditions, the specific venue, and the overall environment of the event.
- COVERAGE OF THE WEDDING DAY
The coverage will begin when the photographer or videographer arrives at the location of the event and will last for the number of hours specified in the client's chosen packages. If the event concludes earlier than expected time, coverage will end even if the maximum number of hours has not been reached.
If coverage hours are surpassed, clients are billed per hour. Payment is due after the shoot.
The outdoor session cannot be moved to a later date in the event of inclement weather. If the client insists on an outdoor session on a different day, additional fees will apply.
There are no outdoor sessions for the night reception, but we can take portraits around the venue.
- CANCELLATION/PACKAGE AMENDMENT
If the event is canceled within two (2) months of the wedding, Ted Visual maintains the right to keep any fees received and the client will be charged a penalty of fifty percent (50%) of the total package as a result of Ted Visual declining other paid assignments.
Clients are not allowed to modify or amend their package less than two months before the event date.
If Ted Visual cancels on the clients, all payments paid will be reimbursed in full to the client nominated bank account within three (3) business days, along with a list of suitable substitutes.
Any payment received is non-transferable/non-refundable if the client changes/cancels or downgrades the package. However, the amount paid may be applied to any photography/videography services at future events.
- PRIVACY
The client gives Ted Visual permission to use my wedding photos in the public domain (for example, as work samples during in-person consultations, sample albums, instructive reasons, and so on).
- MEALS & BREAKS
The client approves of photographers and videographers eating at events. The client understands that photographers and videographers need breaks. Thus, they can occasionally check their phones. The client also informs the reception venue to provide seats and safe storage for photographers and videographers.
- ILLNESS/INJURY/COVID19/EMERGENCY
Ted Visual reserves the right to substitute another team member in the event of a Photographer's illness or personal or family emergency. Ted Visual guarantees that the photographer who will capture the photographs is a competent professional in the event that a substitute is hired for the job.
- SOFTCOPY & BACKUP
Ted Visual keeps client files for 2 weeks after the photography & videography session and is not liable for any claims after this period. All client files will be deleted and backups will be purged after this period.
- CORRUPTED FILES, SYSTEM FAILURE, AND THEFT OF EQUIPMENT
In the event of circumstances outside of Ted Visual control, like memory card loss/corruption, system failure, or equipment theft leading to the inability to complete a service, a refund will be issued to the customer for the affected component's value.
Ted Visual will issue a refund if the product quantity delivered is insufficient due to a specific reason, such as being unable to deliver the album due to a corrupted memory card.
The refund amount depends on the division of the affected product (photo only, video only, or both) from the package. Refund requests will be processed within 30 working days.
I have read, acknowledged, and by booking via Bank Transfer, I agreed to the terms and conditions contained in this Agreement.
